ENRON VICTIM TRUST INFORMATION
FOR PARTICIPANTS WHO RECEIVED STOCK OR ROLLED STOCK OVER |
| |
|
| |
ESOP: If the ESOP distributed stock to you in kind or transferred stock to an IRA or to your account in another qualified plan, and if information regarding what you did with the stock after the distribution or transfer could increase your allowed loss or produce an allowed loss where current calculations show none, the claims administrator for the Enron Victim Trust will contact you in the next several weeks to request information covering the period after the stock left the ESOP. Under the distribution plan for the Enron Victim Trust, if you do not provide that information, the claims administrator must assume you sold the stock at the highest inflation rate (the basis for calculating gains and losses) during the period after the transfer. The gain calculated under that assumption would reduce any claim you may have based on other shares purchased during the claims period. |

| |
SAVINGS PLAN: The claims administrator for the Enron Victim Trust also will contact you if the Savings Plan distributed stock to you in kind or transferred stock to an IRA or to your account in another qualified plan. For purposes of calculating your Enron Victim Trust claim, the distribution is counted as a sale of Enron Stock Fund units in the Savings Plan and a purchase of Enron common stock outside the Savings Plan. The assumption that you sold at the highest inflation rate after the transfer does not apply to your Savings Plan claim, and your Savings Plan claim is complete without additional information. |

• |
If you sold the shares in question prior to October 18, 2001, you will not have incurred an eligible loss from your transactions with respect to those shares outside the Savings Plan. It is therefore unnecessary for you to file a separate claim, as it would not result in a recovery. |
• |
However, if you held the shares until at least October 18, 2001, you should file a claim for those shares showing the date of distribution or rollover as the date of purchase and showing the history of the shares through November 7, 2001. |
