This web site contains information for participants and beneficiaries of the Enron Corp. Savings Plan (the "Savings Plan") and the Enron Corp. Employee Stock Ownership Plan (the "ESOP") about the settlement in the Newby v. Enron Corp. securities litigation. Under an agreement between Enron and the U.S. Department of Labor, Fiduciary Counselors was appointed as the independent fiduciary to act for these Plans in connection with the Newby litigation and settlements. Effective in late December 2012, Fiduciary Counselors Inc. also was appointed Plan Administrator and named fiduciary for the Savings Plan, with responsibility for all aspects of plan administration, including those related to Newby and Enron Victim Trust claims. This appointment was made pursuant to an agreement among Enron Dissolution Corp., the U.S. Department of Labor, the previous plan administrator, and Fiduciary Counselors. This web site also contains information on the Plans' recovery on the claims Fiduciary Counselors filed with the Enron Victim Trust on behalf of participants and beneficiaries in the Plans, as well as Savings Plan distributions of the proceeds of the Plans' recoveries under both settlements to participants and beneficiaries.
 
  TAX QUALIFICATION
  Because the Enron Savings Plan is a tax-qualified plan, Newby distributions are eligible for rollover to IRAs and other qualified employer plans. The IRS Determination Letter stating that the Enron Savings Plan is a tax-qualified plan can be found here.
   
   
 

FINAL DISTRIBUTION FROM PLAN The Enron Corp. Savings Plan ("Savings Plan") is in the process of making the final distribution of all remaining funds in the Savings Plan. These funds represent the remaining proceeds the Savings Plan received for the claims Fiduciary Counselors filed in the Newby private securities litigation settlement and in the Enron Victim Trust, which was established to handle the proceeds of actions brought by the U.S. Securities and Exchange Commission and the U.S. Department of Justice in connection with the fraud at Enron.

On August 3, 2018 we sent participants and beneficiaries notices and election forms for the final distribution. Completed election forms are due at the Enron Savings Plan Newby & EVT Distribution mailing address at Gilardi & Co. by October 2, 2018.

If you currently have an account in either of the successor plans to the Savings Plan – PGE 401(k) Plan and EOG Plan – you will not receive an election form because your share, if any, of the remaining proceeds has been allocated directly to your account in your plan. On Friday, August 10, notices were mailed to participants in the successor plans who are receiving allocations, and those allocations have been posted to participant accounts.

Because this final distribution is substantially smaller than the three previous distributions, fewer participants will receive distributions this time.  We will update this page as new information is available. This page will be updated before any further information will be available from Fiduciary Counselors, Gilardi & Co. or the Enron Victim Trust claims administrator.
